Ce blog vous apporte des informations sur les migrants sans papiers. Je vous pr\u00e9senterai d'abord la v\u00e9ritable signification du terme \u00ab\u00a0migrant sans papiers\u00a0\u00bb, ou \u00ab\u00a0migrant en situation irr\u00e9guli\u00e8re\u00a0\u00bb, plut\u00f4t que le terme malheureusement trop souvent utilis\u00e9 d'\u00ab\u00a0ill\u00e9gal\u00a0\u00bb. Je vous donnerai \u00e9galement des informations sur les migrants sans papiers en Finlande. Les politiques de commerce \u00e9quitable seront \u00e9galement abord\u00e9es dans ce blog, afin de les lier au th\u00e8me plus large et mondial des droits de l'homme. Apr\u00e8s vous avoir donn\u00e9 les informations de base pour alimenter votre r\u00e9flexion, je vous ferai part de ma propre exp\u00e9rience sur le sujet, acquise au travail.<\/p>\n

Qu'est-ce qu'un migrant sans papiers et pourquoi ne devrait-il pas \u00eatre qualifi\u00e9 d'ill\u00e9gal\u00a0? Le professeur Siegel (2021) nous explique qu'\u00e0 un moment donn\u00e9 de sa migration, un migrant en situation irr\u00e9guli\u00e8re, pour une raison ou une autre, n'a pas respect\u00e9 les r\u00e8gles, r\u00e9glementations et lois du pays vers lequel il migre. Ces r\u00e8gles, r\u00e9glementations et lois peuvent affecter l'entr\u00e9e de la personne dans le pays, son s\u00e9jour dans ce pays et, par exemple en Finlande, son droit d'y travailler.<\/p>\n

Les termes \u00ab\u00a0migration irr\u00e9guli\u00e8re\u00a0\u00bb et \u00ab\u00a0ill\u00e9gale\u00a0\u00bb ont fondamentalement la m\u00eame signification. Nous devrions nous efforcer d'utiliser le mot \u00ab\u00a0irr\u00e9gulier\u00a0\u00bb plut\u00f4t qu'\u00ab\u00a0ill\u00e9gal\u00a0\u00bb, car le mot \u00ab\u00a0ill\u00e9gal\u00a0\u00bb sugg\u00e8re en soi qu'il y a quelque chose d'ill\u00e9gal chez la personne migrante. Une personne peut commettre des actes ill\u00e9gaux (comme braquer une banque), mais son existence ne peut \u00eatre ill\u00e9gale.\u00a0<\/p>\n

Le mot \u00ab\u00a0ill\u00e9gal\u00a0\u00bb a d'embl\u00e9e une connotation extr\u00eamement n\u00e9gative, ce qui accro\u00eet la haine que les migrants peuvent d\u00e9j\u00e0 susciter. \u00catre en situation irr\u00e9guli\u00e8re dans sa migration signifie simplement qu'il y a un probl\u00e8me de papiers, g\u00e9n\u00e9ralement r\u00e9gularisable. L'irr\u00e9gularit\u00e9 migratoire ne signifie pas toujours que la personne est entr\u00e9e dans un pays par de faux pr\u00e9textes. Elle peut \u00e9galement signifier que son visa est expir\u00e9 et qu'elle n'a pas quitt\u00e9 le pays, ou qu'elle travaille dans un pays alors que son visa ne le lui permet pas. (Siegel 2021)<\/p>\n

Les migrants sans papiers en Finlande<\/strong><\/p>\n

Rask (2019) explique que les migrants en situation irr\u00e9guli\u00e8re sont particuli\u00e8rement vuln\u00e9rables. Ils vivent dans des conditions difficiles et sont confront\u00e9s \u00e0 de nombreux facteurs de stress, fragilisant ainsi leur sant\u00e9 mentale.<\/p>\n

De plus, ils risquent d'\u00eatre expuls\u00e9s du pays o\u00f9 ils se trouvent. Pour cette raison, les migrants sans papiers ont beaucoup de mal \u00e0 faire confiance aux autorit\u00e9s, ce qui rend presque impossible pour eux de demander, et encore moins d'accepter, de l'aide (Rask 2019).<\/p>\n

Politiques de commerce \u00e9quitable en Finlande<\/strong><\/p>\n

Vous pensiez que j'allais parler des produits issus du commerce \u00e9quitable que vous pouvez acheter dans votre \u00e9picerie locale\u00a0? Eh bien, cette fois, non.\u00a0<\/p>\n

Les politiques et r\u00e9glementations du commerce \u00e9quitable favorisent le bien-\u00eatre, favorisent le d\u00e9veloppement durable et cr\u00e9ent des emplois. Elles orientent le commerce vers des d\u00e9cisions \u00e0 long terme favorables aux droits humains et au bien-\u00eatre environnemental. (Fingo 2017.)<\/p>\n

Les ONG finlandaises (abr\u00e9viation d'organisation non gouvernementale, une organisation \u00e0 but non lucratif qui fonctionne de mani\u00e8re ind\u00e9pendante) et les syndicats ont travaill\u00e9 ensemble pour pr\u00e9parer un programme en dix \u00e9tapes vers un commerce plus \u00e9quitable et durable.<\/p>\n

Voici les 10 \u00e9tapes sur lesquelles ils se sont mis d\u2019accord :<\/p>\n

1. Donner la priorit\u00e9 aux engagements en mati\u00e8re de droits de l\u2019homme et de protection de l\u2019environnement
2. N\u00e9gociations et processus d\u00e9cisionnels d\u00e9mocratiques et transparents
3. Promouvoir un d\u00e9veloppement \u00e9cologiquement durable et des actions contre le changement climatique
4. Garantir les droits de l\u2019homme et promouvoir le travail d\u00e9cent et le d\u00e9veloppement socialement durable
5. Promouvoir la responsabilit\u00e9 des entreprises
6. Garantir un espace politique pour le d\u00e9veloppement durable
7. \u00c9galit\u00e9 d'acc\u00e8s \u00e0 la justice
8. S\u00e9curiser la production locale
9. Assurer la justice fiscale et renforcer la r\u00e9glementation financi\u00e8re

Ma propre exp\u00e9rience avec un irr\u00e9gulier<\/b><\/p>\n

L'\u00e9t\u00e9 dernier, une employ\u00e9e de mon entreprise est soudainement devenue irr\u00e9guli\u00e8re. Venue d'Afrique pour \u00e9tudier en Finlande, elle avait un permis de travail. Ce dernier lui permettait de travailler tr\u00e8s peu d'heures comme femme de m\u00e9nage. Pourtant, elle a commenc\u00e9 \u00e0 travailler pour nous comme assistante de chantier et, apr\u00e8s ses \u00e9tudes, elle est devenue salari\u00e9e \u00e0 temps plein.<\/p>\n

Je ne comprends pas comment elle a pu modifier son contrat de travail de cette fa\u00e7on sans que son permis de travail soit v\u00e9rifi\u00e9. N'avait-il jamais \u00e9t\u00e9 v\u00e9rifi\u00e9 lors de son recrutement\u00a0? Parce que cela ne lui permettait pas d'effectuer le travail pour lequel elle avait \u00e9t\u00e9 embauch\u00e9e.<\/p>

En tant qu'employ\u00e9e, cette jeune fille \u00e9tait toujours aimable et serviable, et travaillait dur dans toutes les t\u00e2ches qu'on lui confiait. Elle avait le sourire aux l\u00e8vres et \u00e9tait heureuse d'apprendre de nouvelles choses. Elle a commenc\u00e9 \u00e0 \u00e9tudier le finnois cinq fois par semaine, et je l'ai aid\u00e9e dans cette d\u00e9marche en lui fixant des horaires matinaux en semaine afin qu'elle puisse suivre les cours le soir.<\/p>\n

Puis, tout \u00e0 coup, j'ai appris qu'elle ne viendrait plus travailler et on m'a formellement interdit de lui r\u00e9server des horaires \u00e0 l'avenir. Je ne saurais toujours pas ce qui s'est pass\u00e9 si mon amie n'avait pas travaill\u00e9 dans l'agence qui nous louait cette fille. Nous n'avons jamais \u00e9voqu\u00e9 ce sujet nomm\u00e9ment, seulement de mani\u00e8re g\u00e9n\u00e9rale, mais cela\u2026
Il \u00e9tait clair pour moi de qui nous parlions.<\/p>\n

Il y a quelque temps, elle a obtenu ses papiers et peut d\u00e9sormais travailler \u00e0 nouveau pour nous. Malheureusement, compte tenu de la situation \u00e9conomique actuelle, nous ne sommes plus en mesure de lui fournir du travail. J'esp\u00e8re que malgr\u00e9 toutes ces difficult\u00e9s au cours des six derniers mois, elle a \u00e9t\u00e9 trait\u00e9e comme une personne \u00e0 part enti\u00e8re. J'esp\u00e8re qu'elle a re\u00e7u le soutien et l'aide n\u00e9cessaires pour redevenir une migrante r\u00e9guli\u00e8re. Car c'est son droit en tant qu'\u00eatre humain.<\/p>\n
